Terms and Conditions:
All tracts will be sold as “Choice” whereas high bidder may take any one of the available tracts, all tracts, or a combination as desired. Tracts will not be combined to be sold. Seller reserves the right to refuse any and all bids. Seller: David G. Small Living Trust
Terms – 10% down at the time of auction. Balance due at closing, which is on or before March 13, 2020 upon seller’s delivery of merchantable abstract and deed.
Possession will be given at the time of closing and all real estate taxes will be prorated to date of closing. CRP Payments will also be prorated to date of closing.
• All land is selling free and clear for the 2020 farming season.
• It will be the obligation of the buyer of tract 4 to report to the Van Buren County FSA and assume the CRP contract currently in place.
• Tracts will be sold per legal description on a more or less basis. For the lump sum price, the bid for each parcel will be multiplied by indicated acres.
• Seller will provide a survey that indicates the property lines where needed. This will only happen when 2 adjoining parcels are sold to separate buyers.
• Buyers shall be responsible for any fencing per Iowa state law.
• This real estate is selling subject to any and all covenants, restrictions, encroachments and easements, as well as all applicable zoning laws.
• The buyer(s) acknowledge that they have carefully and thoroughly inspected the real estate and are familiar with the premises. The buyer(s) are buying this real estate in its “as is” condition and there are no expressed or implied warranties pertaining to the real estate.
• If one buyer purchases more than one tract that are adjacent, the seller shall only be obligated to furnish one abstract and deed. (husband & wife constitute one buyer)
